REAs and Claims: Key Strategies in Federal Contracting Compensation

What happens after you've won the contract award? As any federal contractor will tell you, the contract award is only the beginning — performance presents a whole new series of challenges.

In this webinar, experienced government contracting attorney Maria Panichelli will discuss two key strategies for seeking compensation in connection with unanticipated issues that arise on federal projects: Requests for Equitable Adjustment (REAs) and Contract Dispute Act (CDA) Claims.  First, Maria will provide a primer on REAs, explaining how contractors can use REAs to seek an increase to the price or duration of their federal contracts.  Next, she will cover claims with a specific focus on the differences between REAs and claims, and an explanation concerning when each strategy is more appropriate.  Maria will also discuss the CDA claims appeal and litigation process, as well as common government defenses and subcontractor pass-through claims.  Sign up to learn about important tools to allow you to get paid.

 

About the speaker:

Maria Panichelli is a partner and the chair of the government contracting department at Obermayer Rebmann Maxwell & Hippel LLP. She focuses her practice exclusively on federal government contracting and procurement, guiding her clients throughout the entire life cycle of their federal contracts. She provides comprehensive legal counseling that allows her clients to successfully navigate the complicated legal requirements related to federal contracting while fulfilling their own business goals. Panichelli’s prior legal experience in corporate litigation and risk management counseling has given her a unique perspective. She recognizes that a client must focus on what is best for business, and her goal is to never unilaterally dictate strategy. She seeks to provide clients with the legal advice they need to make the right business decision. To that end, she works with her clients, providing legal counsel while simultaneously being counseled by the client about their particular business needs. Maria works to find a solution that not only solves a client’s legal issues, but advances that client’s business plan and is consistent with that client’s mission.

Government Marketing and Procurement LLC,* Wimberley, Texas, was awarded an $18,000,000 modification (P00005) to contract W912DY-18-D-0024 for Vocera wireless hands-free communications systems and supporting hardware/software infrastructure. Work will be performed in Wimberley, Texas, with an estimated completion date of August 1, 2023. The General Services Administration (GSA) awarded an One Acquisition Solution for Integrated Services Small Business* Pool 3 contract to the joint venture between S4 Inc. and Solutions Development Corporation, called S4-SDC-JV. Under the multiple award, indefinite-delivery, indefinite-quantity contract, the two companies will provide professional service solutions through specific task orders.
